Manufacturer Product Warranty

As the manufacturer of Pool Fences, Pool Nets & Leaf Covers, we offer a “Limited Manufacturer Product Warranty” for these products. The limited warranty guarantees these products to be free from defects in manufacturing for the duration of the warranty periods, which vary by product. For more details about this warranty, such as who is covered, what is covered and what is not covered, please see below. 

Winter Covers, Automatic Pool Covers and Pool Alarm product warranties are not provided by All-Safe. Please see information listed below for each product or contact the manufacturers of the these products directly.

TYPE OF WARRANTY:

This is a limited Manufacturer Product warranty that covers parts and materials only, and does not cover onsite labor of any kind. If your product requires onsite service or repair, you must contact your installing contractor to determine, what, if any, onsite labor warranty coverage they offer.

WHO IS COVERED:

This limited warranty covers single-family residential properties only and is extended to the consumer who originally purchased the product (the “Original Purchaser”) only. It does not extend to any subsequent owner or other transferee of the product. 

WHO IS NOT COVERED:

This warranty does not apply to anyone who obtained their product from an unauthorized seller, prior homeowner, friend, neighbor, family member, secondhand marketplace (Ebay, Craigslist, etc.), or anyone who cannot provide satisfactory proof of purchase from an Authorized Seller of the Product. This warranty cannot be offered by any unauthorized seller of the product.

WHO IS THE MANUFACTURER:

Sunwest Industries Inc. is the manufacturer of the “All-Safe” brand of pool safety barrier materials (the “Product”).

WHAT IS COVERED:

Sunwest (the “Manufacturer”) warrants its pool safety barrier materials (the “Product”) to be free from manufacturing defects for the specified warranty period.

LENGTH OF PRODUCT WARRANTY COVERAGE:

     Ultra Pool Fence: Lifetime Limited Product Warranty*†

     Classic Pool Fence: 5 Year Limited Product Warranty

     5mm Pool Netting: 5 Year Limited Product Warranty

     4mm Pool Netting: 2 Year Limited Product Warranty

     Leaf Pool Cover: 1 Year Limited Product Warranty

     Mesh Pool Cover: Not Warrantied by Sunwest

     Automatic Pool Cover: Not Warrantied by Sunwest

*The warranty coverage period for Products purchased through non-living entities such as a trust, corporation, partnership, church, school, etc., are limited to the lessor of 10 years or the original warranty period (no lifetime coverage).

†Product purchased prior to September 1st 2008 were provided a 10 year warranty. Lifetime does not apply.

 

WHAT IS NOT COVERED: 

Applies to All Products:

1) Demonstrations, adjustments, inspecting, cleaning, removing, replacing, and/or routine maintenance;

2) Normal wear and tear, including weathering, fading and normal gradual sun degradation;

3) Any areas that are difficult to open/close due to improper technique, lack of adequate strength or lack of maintenance;

4) Labor charges or other expenses incurred in connection with inspection, removal or installation of either the original or replacement product;

5) Shipping, handling, freight, delivery charges or damage that may occur while in transit;

6) Costs to secure the area while Product is “awaiting” or “during” repair;

7) Products not manufactured by All-Safe®, which may have their own separate manufacturer warranty (eg: gate latch, hinges, alarms, electrical items);

8) Damage resulting from any of the following:

  a) Pets, animals, rodents, pests, claws, teeth, urine;

  b) Winds of any velocity, fire, earthquake, flood or other natural occurrences;

  c) Accidents, neglect, abuse, misuse (eg: “horseplay”, falling tree limbs);

  d) Improper installation, service, repair, alteration or modification;

  e) Improper use, storage, lack of maintenance;

  f) Heat sources, including barbecues, firepits, gas & electric heaters, reflective windows/mirrors, exhaust from gas powered devices;

  g) 3rd parties such as landscapers, pest control, pool service, property maintenance, neighbors, tenants;

  h) Tools and equipment including leaf blowers (exhaust), weed wackers, lawn mowers, carts, wagons; i) Harsh environments including marine air, salt water (eg: corrosion), hard water (eg: calcium deposits), hot desert climates; 

   j) Algae or mold; 

  k) Lost, missing or stolen items.

Applies to Pool Fencing: 

1) Gate adjustments (eg: normal maintenance); 

2) Broken or bent poles; 

3) Poles stuck in sleeves; 

4) Cut, ripped, torn, punctured, sagging, burned mesh; 

5) Wall attachments that have been pulled out; 

6) Mesh splices; 

7) Mesh pulling from moldings; 

8) Concrete footings that have shifted or settled.

Applies to Pool Netting: 

1) Net Shrinkage; 

2) Broken, cut, abraded, severed or chewed twine; 

3) Tensioning devices including Titan Tools and Ratchets, that have been over-tightened or improperly used; 

4) Storage rollers.

Applies to Leaf Covers: 

1) Punctures, tears, or burns; 

2) Wrinkling or waviness; 

3) Storage rollers; 

4) Bungee cords; 

5) Air pillows

WHAT WE WILL DO: 

If, upon inspection, Sunwest determines, in its sole discretion, that the Product has a manufacturing defect, Sunwest will repair or replace that item with like or similar parts, depending on item availability. If the item is unavailable or discontinued, an alternate style, color, and/or finish may be substituted. Sunwest does not warrant that replacement materials will match or be identical to the original Product. Repairs may be cosmetically visible. All costs and expenses for shipping Product to Sunwest’s facility in Orange, CA is the responsibility of the warranty claimant. Sunwest is not responsible for any costs, fees or expenses associated with onsite installation, attachment, service or adjustment of the original, replaced or repaired Product. 

HOW TO FILE A MANUFACTURER PRODUCT WARRANTY CLAIM: 

To determine if you may qualify for coverage under our Manufacturer’s Product Warranty, and/or to submit a claim, please visit allsafepool.com/warranty.

The following information is required to file a claim: 1) Installation address; 2) Original date of installation; 3) Detailed description of manufacturing defect, issue or concern; 4) 3-5 high resolution photos clearly show the manufacturing defect, issue or concern (additional photos may be required); 5) Copy of Original Purchaser proof of purchase (must contain your name, date of installation, installation address, and name of Authorized Seller. 

Once all required information is received, most claims will be reviewed and responded to within 5 business days. Please be aware that; 1) missing information; 2) claims submitted from anyone other than the Authorized Seller or Original Purchaser; and/or 3) verbal claim requests; will result in automatic denial of your claim and a new claim will need to be submitted. 

Warranty claims may require product to be shipped to our facility located at Sunwest, 648 N Eckhoff Street, Orange, CA 92868.

THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES. SUNWEST DOES NOT AUTHORIZE ANY OTHER PERSON, INSTALLER, CONTRACTOR OR RESELLER TO MAKE ANY OTHER EXPRESS WARRANTIES. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE. IN NO EVENT SHALL SUNWEST BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES ARISING OUT OF OR CONNECTED WITH THE PURCHASE OR USE OF THIS PRODUCT OR FOR ANY BREACH OF WARRANTY.

NO INSTALLER, CONTRACTOR, RESELLER OR OTHER PERSON IS AUTHORIZED BY SUNWEST TO CHANGE THIS WARRANTY OR TO MAKE ANY ADDITIONAL REPRESENTATION, WARRANTY, PROMISE, GUARANTEE OR OTHER ASSURANCE ON BEHALF OF SUNWEST RELATING TO THE PRODUCT. THIS WARRANTY IS NOT TRANSFERABLE TO ANY OTHER PARTY.

Installation Labor Warranty

An installation labor warranty, can only be offered by the reseller that you are purchasing from and that is installing your product. We, as the Manufacturer, do not offer any warranty coverage related to your installation or that requires onsite labor of any kind.

If your installation was through a reseller: You must contact your reseller/installer of your pool safety barrier to determine what, if any, installation labor warranty coverage they offer. Check with your reseller prior to installation.

If you purchased your product from allsafepool.com: There is no installation labor warranty provided since you complete your own installation.

*If your installation was completed by All-Safe Pool Fence & Covers, Orange, CA: You are provided a “90 day Limited Installation Labor Warranty”. You can read a copy of this document below. 

TYPE OF WARRANTY:

This is a limited Installation Labor warranty that covers installation labor only. This type of warranty is often referred to as a “workmanship warranty”. 

WHO IS COVERED:

This limited installation labor warranty covers single-family residential properties only and is extended to the consumer who originally purchased the product (the “Original Purchaser”) only. It does not extend to any subsequent owner or other transferee of the product.

WHO IS NOT COVERED:

This warranty does not apply to anyone who obtained their product from a prior homeowner, friend, neighbor, family member, secondhand marketplace (Ebay, Craigslist, etc.), or anyone who cannot provide satisfactory proof of purchase from Seller.

WHO IS THE SELLER:

The company that you are purchasing from and that is installing your product is considered the “Seller” as it relates to this warranty.

WHAT IS COVERED:

The “Seller” warrants that the installed Product will be free from defects in installation workmanship for the specified warranty period.

LENGTH OF LABOR WARRANTY COVERAGE:

     Pool Fence: 90 Day Limited Installation Labor Warranty

     Pool Netting: 90 Day Limited Installation Labor Warranty

     Leaf Pool Cover: 90 Day Limited Installation Labor Warranty

     Mesh Pool Cover: 90 Day Limited Installation Labor Warranty

Coverage begins on the day of installation.

WHAT IS NOT COVERED: 

Applies to All Products:

1) Demonstrations, adjustments, inspecting, cleaning, removing, replacing, and/or routine maintenance;

  d) Improper installation, service, repair, alteration or modification by anyone other than Seller;

  e) Improper use, storage, lack of maintenance;

  f) Heat sources, including barbecues, firepits, gas & electric heaters, reflective windows/mirrors, exhaust from gas powered devices;

  g) 3rd parties such as landscapers, pest control, pool service, property maintenance, neighbors, tenants;

  h) Tools and equipment including leaf blowers (exhaust), weed wackers, lawn mowers, carts, wagons;

  i) Harsh environments including marine air, salt water (eg: corrosion), hard water (eg: calcium deposits), hot desert climates;

  j) Algae or mold;

  k) Lost, missing or stolen items;

  l) Pre-existing conditions including, but not limited to; coping, bricks, stone, decks, tile, planters, raised walls, etc., that are loose, cracked, broken or that are not a minimum of 6” thick.

Applies to Pool Fencing:

1) Gate adjustments (eg: normal maintenance);

2) Broken or bent poles;

3) Poles stuck in sleeves;

4) Cut, ripped, torn, punctured, sagging, burned mesh;

5) Mesh pulling from moldings;

6) Concrete footings that have shifted or settled. 

Applies to Pool Netting:

1) Net Shrinkage;

2) Broken, cut, abraded, severed or chewed twine;

If the item is unavailable or discontinued, an alternate style, color, and/or finish may be substituted. Seller does not warrant that replacement materials will match or be identical to the original Product. Repairs may be cosmetically visible.

HOW TO FILE AN INSTALLATION LABOR WARRANTY CLAIM: 

To determine if you may qualify for coverage under this Installation Labor Warranty, and/or to submit a claim, please contact us via the information provided at the bottom of this page.

The following information is required to file a claim:

1) Installation address;

2) Original date of installation;

3) Detailed description of installation workmanship defect, issue or concern;

4) 3-5 high resolution photos clearly showing the installation workmanship defect, issue or concern (additional photos may be required);

5) Copy of Original Purchaser proof of purchase (must contain your name, date of installation, installation address, and name of Seller. 

Please be aware that;

1) missing information;

2) claims submitted from anyone other than the Original Purchaser; and/or

3) verbal claim requests; will result in automatic denial of your claim and a new claim will need to be submitted. 

Once all required information is received, most claims will be reviewed and responded to within 5 business days.

Latham Pool Products is the manufacturer of the Automatic Pool Covers brand Pool Cover Specialists that is offered through All-Safe. All-Safe has no ability to determine or approve warranty claims. Automatic Pool Covers come with product & labor warranties, please see below.

Service, Repair or Warranty?

It’s important to understand what is covered by warranty and what is considered repair, maintenance and/or serviceable. Here is a quick list of common items often mistaken as warranty, they are actually serviceable items that you can easily repair on your own. You can also reach out to your installation company for assistance with repair and maintenance items. There may be fees involved.

  • Pool Fence Gate/Door is not Closing
  • Damaged Mesh Fabric

  • Net is too tight/loose
  • Missing Clips
  • Air Pillow not holding air

Filing a Warranty Claim

Product warranty claims are only available for Pool Fences, Pool Nets and Leaf Covers with a “manufacturing defect”.

If your product is in need of maintenance (ex: gate is not closing, net has shrunk) or repair (ex: torn mesh, broken pole, missing clips) please read more about how to repair your product in our knowledgebase, as these items are not covered under the product warranty since they are not defects. Labor Warranty claims are only for customers who had installation directly from All-Safe Pool Fence & Covers in Orange, CA.

If your product was installed by another company/reseller, you will need to contact the company that installed your fence for assistance.

Color Variations

Colors on your screen or brochure may not match the actual color of your product.

Due to the many variations in monitors, phones, and browsers, color samples and product examples may appear different on different screens. Computers and mobile devices are not all calibrated equally and color reproduction on the Internet is not precise. The same is true for printed items such as brochures and other sales literature. 

In addition, the colors of our products photograph differently under different lighting conditions. For example, photos taken in full sunlight will vary from photos taken on a cloudy or overcast day. Similarly, shadows from nearby objects can affect the color and transparency of our products. If a precise color or specific shade is important, please inspect the actual color of your product prior to installation.

Colors will vary from batch to batch.

Many of our products’ materials are not available through typical stores and vendors and therefore must be custom manufactured specifically for our use. In order to control costs and provide you with the best value possible, our raw materials are produced in large batches and can often take several months to receive. The colors of our materials can, and often do, vary slightly from batch to batch. Although we make every effort to minimize color variations, we cannot be responsible for these differences when they occur. If a precise color or specific shade is important, please inspect the actual color of your product prior to installation.

Color names are subjective and may not be what you think the color should be.

For example, we use the name “putty” to describe some of our products. Your idea of the color “putty” may be different than someone else’s idea of “putty”. In addition, products may have the same color name but may not be the exact same color. For example, we have different shades of “black”. Please do not order using color names as your only guide. If a precise color or specific shade is important, please inspect the actual color of your product prior to installation.

If it is important that your product be an exact color or shade, it is highly recommended that you inspect the actual product prior to its installation and address any concerns with your local independent installer. Most independent installers do not offer refunds or accept returns due to color variations.
